New simplifications for repowering projects 🍃

After almost a year of consultation, the Bundestag passed the BImSchG amendment in June. The law also contains key new regulations in the area of repowering: 🔁 5-H regulation: extension of distance and time requirements Extension of the scope of application of the repowering regulations to turbines that are erected within 48 months (instead of the previous 24 months) after the dismantling of the existing turbine and at a maximum distance of five times the total height of the turbine 🔁 Reduced inspection requirements for changes to the turbine type If the turbine type is changed to a small extent (max. 8 metre distance, 20 metre increase, 8 metre reduction in rotor run-out), reduced inspection requirements apply 🔁 Fictitious approval Repowering projects to change the type of turbine and those that are carried out without structural changes or replacement of parts are deemed to be approved after six weeks if no official decision has been issued.

Important draft specification of the Federal Network Agency ⚡🔋

Amendments to the Wind Energy-to-Sea Act: Digitisation of planning and approval procedures

On 29 June, the Commission adopted a proposal for a Directive on the planning safeguards law, which came into force in May 2020, introduced the tool of online consultation, initially limited to the duration of the restrictions imposed by the COVID-19 pandemic. In connection with the amendments to the WindSeeG adopted by the Federal Government today, the formal consultation of the authorities to be involved has been replaced by the publication of the relevant planning documents on the Internet (§ 6 para. 10, § 12 para. 2a, para. 4 sentences 2 and 3, § 47 para. 6 WindSeeG). BNetzA reacts to the impact of the corona virus for tenders under the EEG and the KWKG

Self-sufficiency & general electricity supply in the real estate industry

The #Clearingstelle #EEG #KWKG has already published on December 13, 2018, a notice on #self-sufficiency for so-called general electricity. Self-sufficiency within the meaning of § 61 EEG 2017 also applies in the case of personal identity between the plant operator and the operator of consumption facilities for cooling or heating parts of buildings, community lighting and lifts. In this respect, the Clearingstelle EEG KWKG creates legal clarity for the use of #solar plants and #BHWK in the real estate industry.
