Customer system in EnWG

The OLG Düsseldorf had to decide on the requirements of a #customer plant in the sense of § 3 No. 24a EnWG. Taking into account the exceptional nature of the provision, the Court took the view that spatial closeness requieres a territorial unit created by inner bond, which is interrupted by disruptive or divisive interruption. With regard to the criterion "insignificant for competition", the size and economic weight of the individual case must be assessed under the influence of the undistorted competition created by #regulation, so that they must also be subject to regulation as part of the natural monopoly. 457 connected #last consumers are no longer insignificant in view of the further circumstances. Building capital for subcontractors

BGH decision on building capital: Not only general contractors and property developers, but also subcontractors may be obliged to use the remuneration received for the benefit of the companies which they have commissioned. This also applies if the subcontractor only performs (minor) parts of the construction work. This was decided by the Federal Supreme Court and clarified the application of § 1 BauFordSiG. In the specific case, a subcontractor was commissioned to lay cable routes for a wind farm and in turn commissioned another company to drill the necessary wells, but failed to meet its obligation to pay wages. Accounting transit in EEG 2009

In a decision worthy of criticism in the case of the commercial-accounting transit in the #EEG 2009, the BGH decided that a #biomass cogeneration plant is only eligible for funding in the amount of the net electricity generation, i. e. after deduction of the #plant's own consumption. This also applies if the biomass cogeneration plant has purchased the #electricity requirement externally. For this the BGH strives for a trick on the #KWKG and lets a clean demarcation with the promotion systematics be missing and this always with the argument to avoid unwanted loads at the expense of the end consumer. Exemption of grid charges is illegal

The European Commission has concluded that the exemption from grid charges under § 19 (2) of the Electricity Grid Fees Regulation (StromNEV) old version, which had been granted in Germany to certain large electricity consumers in 2012 and 2013, violated EU state aid rules. There were no reasons to exempt these consumers from paying network charges. Germany must recover the illegal aid. Reclaims in the three-digit million range are not excluded.

Neue Festlegung Regelenergie

Die #BNetzA hat mit Datum vom 8. Mai 2018 Änderungen hinsichtlich der Ausschreibung der #Sekundärregelleistung und der #Minutenreserve beschlossen. Hierbei soll ab dem 12.07.2018 nicht mehr allein der Leistungspreis entscheidend sein, sondern der Leistungspreis addiert mit einem gewichteten Arbeitspreis als sogenannter Zuschlagswert wird bei der Ausschreibung durch die #Übertragungsnetzbetreiber herangezogen. Hintergrund waren hohe Preise in der Merit-Order bei Abruf der Leistung innerhalb einer halben Stunde, die durch die #Bilanzkreisverantwortlichen zu tragen waren.
