“Neighbour liability – Increased liability risk following a BGH ruling on neighbour liability ” from Hauer

“In a recent ruling, the BGH had to decide on the liability of a landowner for a damage to the neighbouring land caused by a fire.  A landowner had hired a craftsman to repair the roof of his house. He had carefully choosen the craftsman beforehand. During hot-gluing work on the roof, a house fire was caused by the craftsman. The neighbouring house was considerably damaged by the fire. Since the craftsman was insolvent, the question came up whether or not the landowner is to be taken into adhesion for the damage at the neighbour house. After the two lower courts denied a claim of the neighbour against the landowner, the BGH came to a decision.[…]”

Rezension: Frenz/Müggenborg/Cosack/Hennig/Schomerus (Hrsg.), EEG – Erneuerbare-Energien-Gesetz

“Der nunmehr in seiner 5. Auflage erschienene Kommentar zum Erneuerbare-Energien-Gesetz ist das derzeit umfassendste Werk zum EEG 2017. Der Kommentar erscheint in zwei Teilen, wobei die Anlagen und Verordnungen im Franz EEG II Kommentar zusammengefasst sind. Auf 2037 Seiten erläutern aus dem Energierecht bekannte und renommierte Experten die Neuregelungen des vollständig durch den Gesetzgeber überarbeiteten Gesetzes. Es ist bemerkenswert, dass die insgesamt 30 Autoren innerhalb kürzester Zeit auch nach Inkrafttreten des Mieterstromgesetzes die notwendigen Änderungen vollumfassend eingearbeitet und somit für Praktiker und Wissenschaftler eine der wesentlichen Arbeitsgrundlagen im Energierecht geschaffen haben. Nicht zuletzt ist es den Herausgebern zu verdanken, dass sie die Vielzahl an Autoren aus Praxis und Wissenschaft mit einem hohen Anspruch an Qualität, Erfahrung und Fachkompetenz vereinen konnten, um die komplexe Regelungsmaterie des EEG 2017, die sich nunmehr auf über 172 Paragraphen erstreckt, abbilden zu können.[…]”

“EEG-conform measurements in “bivalent” storage facilities” by Hauer/Brahms

The current version of the Renewable Energy Sources Act finally regulates also the “bivalent” operation of battery storage facilities, i. e. the use both for own consumption and for feeding into the grid. However, the correct recording of energy flows remains an uncertainty factor. The Federal Association of Energy Storage has tackled the problem and published a corresponding measurement concept.
